By using the service, you consent to the practices described here.

1. Scope of This Policy

This policy applies to personal data collected through the digitalpatra.in website, our WhatsApp business number, and email correspondence with support@digitalpatra.in, in connection with the preparation, e-stamping, electronic signing and delivery of rental agreements. It applies to data about customers as well as the other parties named in an agreement.

2. Information We Collect

To prepare and execute your agreement we collect: your name, email address and WhatsApp number; the details of the parties to the agreement (names, addresses, contact numbers); property details (address, rent, deposit, duration and related terms); and any supporting documents you choose to upload. We also collect payment confirmation details from our payment gateway (we do not store your card or UPI credentials) and standard technical data such as device and log information when you use the website.

Aadhaar data: We do not collect, store or ever see your Aadhaar number. Aadhaar authentication during signing happens directly between you and the licensed eSign Service Provider empanelled under the Information Technology Act. We receive only the digitally signed document and the signing audit trail (such as timestamps and signature validity data) needed to complete and evidence the execution of your agreement.

3. How We Use Your Information

We use your personal data to: prepare your draft agreement and incorporate your corrections; procure the government e-stamp for the applicable stamp duty after you approve the draft; coordinate Aadhaar eSign for all parties; deliver the final signed document by email and WhatsApp; send service messages about your order (drafts, payment confirmations, signing links, delivery); respond to support requests; and comply with legal and tax obligations. We do not use your agreement data for advertising, and we do not send promotional messages without your consent.

4. Legal Basis and Your Rights (DPDP Act, 2023)

We process your personal data on the basis of your consent, and only for the specific purposes described in this policy (purpose limitation), in accordance with the Digital Personal Data Protection Act, 2023. You have the right to: access a summary of the personal data we hold about you; request correction of inaccurate or incomplete data; request erasure of your data once it is no longer required for the purpose it was collected or for legal compliance; withdraw your consent at any time (which may mean we cannot complete a pending order); nominate a person to exercise your rights in the event of death or incapacity; and raise a grievance as set out in Section 10 below. We retain personal data only for as long as needed to provide the service, honour re-delivery requests, and meet legal, accounting and dispute-resolution requirements, after which it is deleted or anonymised.

5. Data Security

Your data is encrypted in transit using industry-standard TLS, and stored in access-controlled systems where access is limited to personnel who need it to process your order. We take reasonable security safeguards as required under applicable law to prevent unauthorised access, disclosure, alteration or destruction of your personal data. No system is perfectly secure; if we become aware of a personal data breach affecting you, we will notify you and the Data Protection Board of India as required by law.

6. Sharing of Information

We share your data only with the service providers strictly necessary to execute your document: the government-authorised e-stamping infrastructure (to purchase the e-stamp for your agreement), the licensed eSign Service Provider (to enable Aadhaar-based signing), and our payment gateway (to process your payment). Each receives only the data it needs for its function. We may also disclose data where required by law, court order or a government authority. We never sell your personal data, and we do not share it with advertisers or data brokers.

7. Indemnity

You agree to indemnify and hold DigitalPatra harmless from claims, losses and expenses arising out of personal data you submit about other persons without their authority, or out of your breach of this policy or applicable law. When you provide personal data of other parties to an agreement, you confirm you are authorised to do so.

8. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under this policy where the failure results from events beyond our reasonable control, including acts of God, natural disasters, war, civil disturbance, government action, outages of government e-stamping or eSign systems, telecom or internet failures, or cyber incidents despite reasonable safeguards.
